PAIN311 ("we," "us," or "our") is a case management and marketing network based in Chicago, Illinois. Our services include:

• Qualifying auto accident cases for referral to licensed Illinois personal injury attorneys
• Facilitating attorney retainer execution between clients and licensed attorneys
• Coordinating medical appointments with lien-based medical providers
• Providing ongoing case management and communication throughout the legal process

PAIN311 is compensated by attorney partners and medical providers for marketing and case management services. We do not charge fees directly to clients. Our services are free to accident victims.

2. No Attorney-Client Relationship with PAIN311

PAIN311 is not a law firm. No communication with PAIN311 — including phone calls, text messages, emails, or form submissions — creates an attorney-client relationship with PAIN311 or any of its staff.

An attorney-client relationship is only formed when you execute a written retainer agreement directly with a licensed attorney. Until that retainer is signed, no attorney-client relationship exists.

Nothing communicated by PAIN311 staff, our website, our Voice AI agent, or any automated system constitutes legal advice.

3. No Guarantee of Results

PAIN311 does not guarantee any particular outcome in your legal case. We do not guarantee:

• That you will be matched with an attorney
• That an attorney will accept your case
• Any specific settlement amount or legal outcome
• The timeline of your case
• The availability of medical providers in our network

The attorneys in our network make independent professional judgments about case acceptance. PAIN311 does not control or direct the legal work performed by any attorney.

4. Eligibility

Our services are available to individuals who:

• Are 18 years of age or older
• Have been involved in an auto accident in Illinois or another state where we operate
• Are seeking legal and/or medical assistance related to that accident

We reserve the right to decline to provide services to anyone at our discretion.

5. Accuracy of Information

By submitting an intake form or providing information to PAIN311, you represent that the information you provide is accurate and complete to the best of your knowledge. Providing false or misleading information may affect the handling of your case and may have legal consequences.

You agree to promptly notify PAIN311 of any changes to the information you have provided.

6. SMS and Phone Communications

By providing your phone number to PAIN311, you expressly consent to receive autodialed or pre-recorded SMS text messages and phone calls from PAIN311 at the number provided, for purposes related to your case intake and case management.

• Reply STOP to opt out of SMS messages at any time
• Reply HELP for assistance or call 888-PAIN-311

Your consent to receive SMS messages is not a condition of receiving our services.

7. Voice AI Disclosure

PAIN311 uses an automated Voice AI system to handle inbound calls to 888-PAIN-311. This system:

• Is an automated intake agent — not a licensed attorney or human staff member
• May record your call for quality and documentation purposes
• Collects intake information to be reviewed by a human PAIN311 representative
• Does not provide legal advice

By calling 888-PAIN-311, you consent to interacting with our automated Voice AI system and to call recording. A human representative will follow up on all qualified cases.

8. Third-Party Attorney and Medical Services

The attorneys and medical providers in the PAIN311 network are independent professionals. They are not employees or agents of PAIN311. PAIN311 is not responsible for:

• The legal advice or representation provided by any attorney
• The medical treatment provided by any medical provider
• The outcome of any legal case or medical treatment
• Any disputes between you and an attorney or medical provider

Your relationships with attorneys and medical providers are governed by separate agreements with those professionals.

9. Free Services to Clients

PAIN311's case management services are provided at no direct cost to accident victims. We are compensated by attorney partners and medical providers through flat marketing and administrative service fees. These fees do not come out of your settlement and are not charged to you.

Attorney fees, if applicable, are governed by your retainer agreement with your attorney and are typically contingency-based — meaning attorneys are paid only if you win your case.

10. Confidentiality Limitations

Communications with PAIN311 are not protected by attorney-client privilege. While we treat your information with care and share it only as necessary to provide our services (as described in our Privacy Policy), communications with PAIN311 do not carry the same legal protections as communications with your attorney.

Once you are connected with a licensed attorney and a retainer is executed, communications with that attorney are protected by attorney-client privilege.

11. Intellectual Property

All content on pain311.com — including text, graphics, logos, and design — is the property of PAIN311 and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

12. Limitation of Liability

To the fullest extent permitted by law, PAIN311 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Failure to be matched with an attorney or medical provider
• Outcomes of your legal case or medical treatment
• Technical errors or interruptions in our services
• Reliance on information provided by our website or Voice AI agent

Our total liability to you for any claim arising from use of our services shall not exceed $100.

13. Indemnification

You agree to indemnify and hold harmless PAIN311 and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these Terms, or your provision of false or misleading information.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Cook County, Illinois.

You agree to attempt to resolve any dispute informally by contacting PAIN311 first before initiating formal legal proceedings.

15. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. We will post the updated Terms on this page with a revised effective date. Your continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and PAIN311 regarding your use of our services. They supersede all prior communications and agreements.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
